This Privacy Statement describes the types of information Ampion Inc. and its affiliates (“Ampion”, “we”, “our” or “us”) collects from and about you when you visit our websites (each a “Site”). This Privacy Statement also explains how Ampion may use and disclose such information, as well as your ability to control certain uses of it.
By using the Site, you agree to the collection, use, and disclosure of your information as described in this Privacy Statement. If you do not, please do not use the Site.
HOW WE COLLECT YOUR INFORMATION
INFORMATION YOU PROVIDE
Ampion collects personal information from you when you choose to share it with us. This may include when you use our Site, create an online account with us, sign up for services, request information from us, sign up for newsletters or our email list, participate in a survey or promotion, provide comments or participate in an online discussion, or otherwise contact us. The personal information we collect may include your name, address, email address, telephone / mobile number, photo, username, date of birth and, if you make a purchase from us, enter into a contractual relationship with us, a credit/debit card number, other financial information, utility account information (including a copy of your utility bill).
INFORMATION AUTOMATICALLY COLLECTED
On our Site we may use cookies, web beacons, log files, HTML5, or other technologies to collect certain information about visitors to our Site and interactions with our emails and online or mobile advertisements, and to allow Ampion to keep track of statistical information which enables Ampion to improve its Site and provide you with more relevant content and advertising on our Site and other sites.

MICROSOFT CLARITY AND MICROSOFT ADVERTISING
We partner with Microsoft Clarity and Microsoft Advertising to capture how you use and interact with our website through behavioral metrics, heatmaps, and session replay to improve and market our products/services. Website usage data is captured using first and third-party cookies and other tracking technologies to determine the popularity of products/services and online activity. Additionally, we use this information for site optimization, fraud/security purposes, and advertising. HOW WE USE INFORMATION
Ampion may use the information we collect from and about you for any of the following purposes:
- To allow you to register and create an account or profile, provide service, and personalize your overall experience
- To validate, confirm, verify, deliver, install, and/or track your provided services
- To respond to your questions, receive your feedback, and communicate with you
- To enhance your experience on the Site, including as a way to recognize you and welcome you

AMPION AFFILIATES
We may share your information with our affiliated companies which may not share the Ampion name.
SERVICE PROVIDERS
We may share your information with third party service providers that provide business, professional or technical support functions for us, help us operate our business and the Site, or administer activities on our behalf.
UTILITIES
We will share your information with your utility to request historical usage and to provide your utility company with allocation information.
DEVELOPERS
We will provide analytics, including credit, payment and billing transactions, to the owners of solar farms or other generators to which you will be subscribed.
OTHER THIRD PARTIES
We may share your information with our select partners, sales agents and other third parties that we believe may have offers of interest to you.
LEGAL MATTERS & SAFETY
We may share your information to respond to the judicial process or provide information to law enforcement or regulatory agencies or in connection with an investigation on matters related to public safety, as permitted by law, or otherwise as required by law. We may also share your information, as necessary, if we believe that there has been a violation of our Terms of Use, of our rights, or of the rights of any third party.
SALE OR TRANSFER OF BUSINESS OR ASSETS
In the event that we, or any of our businesses, are sold or disposed of, whether by merger, sale of assets or otherwise, or in the event of insolvency, bankruptcy, or receivership, personal and other information of our customers and visitors to the Site may be one of the assets sold or merged in connection with the transaction or the due diligence related to a proposed transaction of this type.
WITH YOUR PERMISSION
We may share your information as disclosed to you at the time of collection, or as you otherwise permit us. Ampion may also share aggregate or anonymous non-personal information with third parties for their marketing or analytics uses.
YOUR DATA SOVEREIGNTY/PRIVACY RIGHTS
If you are a resident of any of the states that have enacted Privacy Legislation (such as CA, CO, CT, UT, and VA), you may request information about our disclosure of personal information to third parties or affiliated companies which do not share the Ampion name for their direct marketing purposes. To make such a request, please contact us at help@ampion.net. You must put the statement “Data Privacy Rights” in the subject field. We are not responsible for notices that are not labeled or sent properly, or do not have complete information.
Please note that Ampion will be unable to delete certain data, including payment credentials if You are still subscribed to an active generating facility or have outstanding charges that need to be paid.
Ampion may also retain data to fulfill regulatory requirements such as Payment Card Industry Data Security Standard (PCI DSS) data retention policies.
ACCESS TO YOUR INFORMATION
You may access and update certain information by adjusting your profile and settings on the Site.

CHILDREN’S PRIVACY
Protecting children’s privacy is important to Ampion. The Site is intended for general adult audiences and are not directed or intended for, and we do not knowingly collect any personal information from, individuals under 13 years of age. If we learn that a child under the age of thirteen has provided personally identifiable information to the Site, we will use reasonable efforts to remove such information from our files.
